Please read these Terms and Conditions (“Terms”) carefully before using the services offered by S K Enterprise (“us,” “we,” or “our”). Your access to and use of our services is conditioned on your acceptance of and compliance with these Terms.
1. Agreement to Terms
By purchasing or using our digital services (including but not limited to website design, thumbnail design, social media management, and n8n workflows), you agree to be bound by these Terms.
2. Services
We provide digital services as described on our website. The specific scope of work, deliverables, timelines, and revision rounds for any service will be detailed in a formal proposal or service agreement provided to you before the commencement of work.
3. Client Obligations
You agree to provide all necessary information, materials (e.g., text, images, logos), and access (e.g., to website backend or social media accounts) required for us to perform the services in a timely manner. Delays in providing these materials may result in project delays for which we are not responsible.
4. Orders and Payments
All prices are listed in Indian Rupees (INR) unless otherwise specified.
Payment is required before the commencement of any service, unless an alternative payment plan (e.g., for large projects or recurring services) has been mutually agreed upon in writing.
We use PayU as our third-party payment processor. By making a payment, you agree to be bound by Payment provider’s Terms of Service.
You are responsible for any applicable taxes, such as GST, which will be added to your invoice.
5. Revisions and Approvals
For creative services like website and thumbnail design, the number of included revision rounds will be specified in the project proposal. Additional revisions beyond the agreed scope will be subject to extra charges. A service is considered complete and approved upon final delivery or after a specified review period without requested changes.
6. Social Media Management Services
Services for Social Media Management are provided on a monthly subscription basis. Payments are billed in advance for each service period. You may cancel your subscription by providing us with at least 15 days’ written notice before your next billing date.
7. Intellectual Property
Upon receipt of full and final payment, you will own the finished deliverables (e.g., the final website design, thumbnail images). We retain the right to showcase the completed work in our portfolio and marketing materials unless a non-disclosure agreement has been signed. We also retain ownership of all draft concepts, source files, and underlying methodologies.
8. Limitation of Liability
To the maximum extent permitted by law, S K Enterprise shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, resulting from your use of our services. Our total liability for any claim shall not exceed the amount paid by you for the service in question.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice by posting the new Terms on this page.
